The terms that apply when you use this website or book a session with Farida Alvi Photography

Welcome to Farida Alvi Photography (“I,” “me,” “my,” or “the Studio”). These Terms of Service explain the terms that apply when you visit this website, submit an inquiry, book a photography session, purchase products, or otherwise use my services. By using this website or booking with me, you agree to these Terms.

These website terms are intended to provide general information about how I work. Session-specific details, pricing, deliverables, payment schedules, cancellation terms, image-use permissions, and product orders may also be set out in your proposal, invoice, booking confirmation, session agreement, model release, or written correspondence with me. If there is a conflict between these Terms and a signed client agreement, the signed client agreement will apply to the extent of that conflict.

1. Acceptance of These Terms

By accessing this website, submitting a contact form, scheduling a consultation, booking a session, purchasing photography services or products, or communicating with me about a booking, you confirm that you have read, understood, and agree to these Terms of Service.

If you are booking a session on behalf of your family, child, newborn, partner, or another person, you confirm that you have the authority to make decisions related to the session, payments, image selection, product orders, and any permissions granted for the session.

If you do not agree with these Terms, please do not use this website or book services through Farida Alvi Photography.

2. Photography Services

Farida Alvi Photography provides portrait photography services, including maternity, newborn, family, and related photography sessions. Services may include consultation, session planning, wardrobe or styling guidance, photography time, image curation, professional editing, online proofing, in-studio viewing, digital image options, prints, albums, wall art, and other products, depending on the package or service selected.

The exact scope of your session will be based on the package, proposal, invoice, agreement, or written confirmation provided to you at the time of booking. Any timelines, session lengths, locations, image quantities, print credits, upgrades, or included products should be confirmed in writing before your session.

I reserve the right to update service offerings, packages, prices, availability, and product options at any time. Changes will not affect a confirmed booking unless otherwise agreed in writing.

3. Inquiries, Consultations & Bookings

Submitting an inquiry through this website does not guarantee availability or create a confirmed booking. A session is only confirmed once any required agreement has been completed, any required retainer or payment has been received, and I have confirmed the booking in writing.

Consultations, discovery calls, emails, and planning conversations are used to understand your goals, preferences, timeline, location needs, wardrobe considerations, and any important details related to your session. You are responsible for providing accurate information, including due dates, child ages, family size, preferred session type, location restrictions, accessibility needs, and any other details that may affect the session.

For maternity and newborn photography, session timing is especially important. Recommended timing and availability are provided as guidance only, and I cannot guarantee a specific result if a session is booked outside the recommended window or if circumstances change.

4. Fees, Payments & Retainers

All fees, retainers, balances, taxes, product costs, upgrades, travel fees, studio rental fees, rush fees, additional person fees, extended-family fees, or other charges will be communicated through your proposal, invoice, agreement, or written correspondence.

A retainer or full payment may be required to reserve your session date. Unless otherwise stated in your written agreement or invoice, retainers are applied toward the total cost of your session and may be non-refundable because the date and time are reserved specifically for you.

Final images, galleries, downloads, prints, albums, wall art, or other products may be withheld until all outstanding balances are paid in full. Prices are subject to change for future bookings, unconfirmed sessions, additional products, upgrades, or orders placed after the original booking.

5. Cancellations, Rescheduling & Late Arrivals

If you need to cancel or reschedule your session, please contact me as soon as possible. Rescheduling is subject to availability and may be affected by studio schedules, weather, lighting conditions, newborn timing, due dates, family availability, or other practical considerations.

Outdoor sessions may need to be rescheduled due to unsuitable weather, unsafe conditions, poor light, or other circumstances outside of my control. I will work with you to choose the best available alternative date when rescheduling is necessary.

Please arrive on time and prepared for your session. Late arrivals may reduce the amount of shooting time available and may limit the final variety of images. If a client is significantly late, unavailable, or unable to proceed, the session may be treated as cancelled or rescheduled according to the terms of the applicable agreement.

6. Client Responsibilities & Session Safety

You are responsible for preparing for your session, following reasonable session guidance, supervising children and guests, and ensuring that all participating individuals are ready and able to safely take part. Please share any important details in advance, including health concerns, mobility needs, allergies, sensitivities, feeding schedules, nap schedules, or anything else that may affect comfort or safety during the session.

For newborn and child sessions, safety and comfort are always prioritized. Certain poses, props, wraps, setups, or image concepts may not be possible for every baby or child. I reserve the right to adjust or decline any pose, setup, location, or request that I believe may be unsafe, unsuitable, or outside the intended style of the session.

Clients and guests are expected to treat the studio, wardrobe items, props, equipment, rented spaces, outdoor locations, and other people with care and respect. You may be responsible for damage caused by you, your child, your guests, or anyone attending the session on your behalf.

7. Image Selection, Editing & Delivery

After your session, I will curate and professionally edit images according to my artistic style. Final image selection, editing decisions, colour treatment, retouching approach, cropping, and overall creative direction are part of the service provided by Farida Alvi Photography.

Unedited files, RAW files, rejected images, test shots, duplicates, or images that do not meet my professional standards are not included unless expressly agreed in writing. Requests for additional retouching, advanced edits, rush delivery, extra images, or changes outside the included editing scope may be subject to additional fees.

Delivery timelines are estimates and may vary depending on workload, season, product production schedules, client response times, payment status, or circumstances outside of my control. Digital galleries, proofing links, downloads, print orders, albums, and other products may be available for a limited time, so please download or order within the timeframe provided.

8. Copyright, Personal Use & Image Licensing

All photographs, images, website content, written content, designs, layouts, and creative work produced by Farida Alvi Photography are protected by copyright and remain the intellectual property of Farida Alvi Photography unless otherwise agreed in writing.

When digital images are included with your package or purchased separately, you receive a personal-use license. This means you may download, print, share, and enjoy the images for personal, non-commercial purposes. You may not sell the images, enter them into commercial use, submit them for publication, transfer them to vendors for advertising, alter them for commercial purposes, or claim authorship without written permission.

Please do not apply filters, heavy edits, screenshots, AI alterations, or other changes that misrepresent the final edited work when sharing images publicly. Credit is always appreciated when posting online.

9. Portfolio, Marketing & Model Releases

Use of client images for my portfolio, website, social media, sample albums, studio displays, advertising, awards, education, or other marketing purposes is governed by your session agreement, model release, or written permission.

If you have privacy concerns or prefer that certain images not be shared publicly, please let me know before your session or before signing any release. I will do my best to honour written image-use preferences, subject to any agreement already in place.

For sessions involving children, newborns, or other minors, image-use permissions must be provided by a parent or legal guardian.

10. Products, Prints & Third-Party Services

Prints, albums, wall art, cards, digital products, and other items may be produced by professional labs, gallery platforms, payment processors, booking tools, or other third-party service providers. Product availability, production times, shipping times, colours, materials, finishes, and lab policies may vary.

Because photography products are often custom-made, print and product orders may be final once submitted to production unless there is a verified production defect or an error caused by the Studio. Please review image selections, spelling, sizes, quantities, crops, and shipping details carefully before approving an order.

This website may contain links to booking tools, proofing galleries, social media platforms, payment processors, or other third-party websites. I am not responsible for the content, policies, availability, or practices of third-party websites or services.

11. Limitation of Liability, Changes & Governing Law

Farida Alvi Photography will make every reasonable effort to provide a professional, thoughtful, and high-quality experience. However, photography can be affected by factors outside of my control, including weather, lighting, timing, client preparation, child or newborn temperament, illness, location restrictions, equipment issues, technology issues, product delays, or unexpected events.

To the fullest extent permitted by law, my liability for any claim related to this website, a session, image delivery, or product order will be limited to the amount paid by you for the specific service or product giving rise to the claim. I will not be responsible for indirect, incidental, special, or consequential damages.
